These Terms of Use (“Terms”) govern your access to and use of Decompress.Health, Inc. (“Decompress.Health,” “we,” “us,” or “our”) and our associated website, mobile application, and services (collectively, the “Platform”). By using the Platform, you agree to these Terms, our Privacy Notice, and any additional policies referenced herein. If you do not agree, do not use the Platform.

 

1. Platform Overview and Scope of Services

 

Decompress.Health provides users with tools to share Apple Health data (with explicit permission) in order to receive personalized, non-diagnostic recommendations. These may include suggestions to see a medical provider, explore a service, or track a health-related trend. We may also assist with scheduling through third-party providers.

 

We do not provide clinical diagnoses, treatment plans, or medical advice. Our services are not a substitute for professional medical care, nor do we form any doctor-patient relationship.

 

The information presented on or through the Platform is made available solely for general information purposes. We do not warrant the accuracy, completeness or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Platform, or by anyone who may be informed of any of its contents.

 

We reserve the right to withdraw or amend this Platform, and any service or material we provide on the Platform, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Platform is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Platform, or the entire Platform, to users, including registered users.

 

2. Not for Emergencies

 

This Platform is not designed to respond to emergencies. Never use it for urgent or life-threatening situations. If you believe you are experiencing a medical emergency, call 9-1-1 immediately.

 

You should continue to consult with your primary provider and other healthcare professionals as recommended. Always seek the advice of a physician or other qualified healthcare provider concerning questions you have regarding a medical condition and before stopping, starting, or modifying any treatment.

 

3. User Consent and Use of Apple Health Data

 

We only access your Apple Health data with your active consent. You choose what categories of data to share. We use this information to:

• Provide general health trend insights;

• Offer non-medical suggestions based on your data;

• Help coordinate or schedule services with third parties.

 

We never sell your personal health data. All data is stored securely and handled in accordance with applicable privacy laws, including HIPAA, where applicable. You may revoke access at any time.

 

We may de-identify and aggregate data for research, analysis, or service improvement.

 

4. Telehealth and Provider Services

 

By using telehealth Services, you acknowledge potential risks, including:

• Information may not be sufficient for proper medical decision-making;

• Delays in evaluation due to equipment issues;

• Lack of access to records may cause adverse reactions;

• Despite strong security protocols, data breaches could occur.

 

Any medical services accessed through the Platform are provided by licensed third parties. We are not responsible for those services.

 

5. Privacy Practices

 

Your use of the Platform is subject to our Privacy Notice and the Notice of Privacy Practices of any provider group you engage through our Platform.

 

We use encryption and other safeguards to protect your data. However, no system is 100% secure. You agree to use secure passwords and safeguard your account.

 

6. Prescription Policy

 

Prescription products require a valid consultation and approval by a licensed provider. You may fill your prescription at any pharmacy of your choice. You agree to use prescribed products solely for your personal use and to follow all labeling instructions.

 

7. Ownership and Acceptable Use

 

All materials on the Platform—including software, design, logos, and content—are the property of Decompress.Health or its licensors. You may use the Platform only for personal, non-commercial purposes.

 

You agree not to:

• Modify, distribute, or misuse Platform materials;

• Use automated tools to scrape or access content;

• Violate security or use others’ credentials;

• Upload false, illegal, or harmful content.

 

8. Availability and Restrictions

 

The Platform is only available in certain jurisdictions. You represent that you are not prohibited by law from accessing the services. Accessing the Platform from restricted areas is not permitted.

 

9. Account Access and Responsibilities

 

You are responsible for keeping your login credentials secure and accurate. You agree not to share your password or impersonate anyone. If you misuse your account, we may suspend or terminate it at our discretion.

 

10. Communications, Recordings, and Marketing

 

By providing your mobile number, you consent to receive calls or texts related to the Platform. Decompress.Health or your provider may record interactions for quality and training. You consent to these recordings, which will be kept confidential.

 

11. Dispute Resolution and Arbitration

 

All disputes shall be resolved through binding arbitration. You waive your right to a jury trial or participation in a class action. Disputes must first be communicated via certified mail. The full arbitration terms, including AAA rules, are detailed above.

 

12. Indemnification

 

You agree to indemnify Decompress.Health for any claims or losses resulting from your use of the Platform, your violation of these Terms, or infringement of third-party rights.

 

13. Disclaimers

 

The Platform is provided “as is” with no warranties of any kind. We do not guarantee accuracy or uninterrupted access. You are responsible for your reliance on any content or insights.

 

14. Limitation of Liability

 

Our total liability to you for any claim arising from the Platform is limited to $500. We are not liable for indirect or consequential damages.

 

15. Force Majeure

 

We are not liable for delays or failures caused by events outside our control, including natural disasters, war, or government action.

 

16. Copyright and Intellectual Property

 

All trademarks, logos, and service marks are owned by Decompress.Health or respective third parties. Unauthorized use is prohibited.

 

17. Changes to Terms

 

We may modify these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
